You are mistaken in assuming that it's incompetence--after all, the outcome was just the same as when the Interior Dept "mistakenly" left out the needed contact clause that charged a real royalty rate--gee, too bad: some bigwig gets to keep a ton of money.
The alternative is to acknowledge that nobody can make that many mistakes, all with bad outcomes, and to realize that Bush is the Antichrist, and in his wake follow destruction, chaos, death and despair. Over the top, I know, but I've been reading about our secret prisons.
Their seems to be a run on government lawyers leaving out important citations or making erroneous arguments that alter the intent of a statute. You sometimes wonder what it takes to pass the bar these days. Apparently, not much in the way of understanding the law or developing reasoned arguments.
