What's Good For the Goose....

As Bush left for Camp David on Friday afternoon, he made the following statement to reporters outside the White House:
Special Counsel Fitzgerald's investigation and ongoing legal proceedings are serious, and now the proceedings -- the process moves into a new phase. In our system, each individual is presumed innocent and entitled to due process and a fair trial.
Anyone care to guess how Jose Padilla's attorney will start his next legal brief?

Kind of like the way the Supreme Court ruled that the Equal Protection Clause prohibits States from using "... standards for accepting or rejecting contested ballots [that] might vary not only from county to county but indeed within a single county..." (Bush v. Gore, 2000). Apply that same rule to juries applying standards differently from county to county- or within the same county- in death penalty cases and where does that leave you?

But Padilla is brown. And a former gang member. And an eeevil islamofascist. Each and every one of those categories is automatically (but silently) excluded from the treatment that white Christian Republican Scooter Libby gets.

Never mind that those aren't legal distinctions, or that in the 4th Circuit, as long as the Bush Administration says you're a terrorist, there is no right of Habeas Corpus for you. I haven't totted up the votes recently, but once the Padilla cast gets to the SCOTUS (again), I'm wondering if there will be Habeas Corpus anywhere in the US if the government claims you're a terrorist.

277fia & Paperwight: When Bush stepped up to the microphone and reminded us all about innocent until proven guilty, my first thought was "Except for Jose Padilla." People in America should be OUTRAGED about this case!
He hasn't even been charged!
It's just like the torture that goes on in our names...I just don't recognize this country anymore.

julie, I didn't realize that other people were following the Padilla case. I brought up Padilla's name to couple of people this weekend. While they didn't remember who Jose Padilla was at first, they agreed wholeheartedly that he is entitled to a trial.

To Malkin's credit, she at least posted a link to the Padilla opinion. I just didn't want to waste my time writing a letter so her highly paid secretary could read and delete it.

I suspect that Malkin is used as a testing ground for stories. Within the last couple of months, she had a link to a story about an Egyptian college student in Tennessee picked up for buying pilot manuals and a pilot's uniform with a credit card. The story sounded preposterous and I refused to even check out the link.

I suppose I should have just to see which paper is going along with this propaganda b.s.

I've gone back to reading the paper in hard copy because I got tired of letting every intelligence agency in the world know what stories I was reading.

BAGHDAD - Five hundred prisoners walked free from the U.S. military's Abu Ghraib jail in Iraq on Tuesday, released in a goodwill gesture to mark the end of the Muslim holy month of Ramadan. The detainees were presented with a Koran and $25 on their release which marked Eid al-Fitr celebrations. Their release was in addition to 1,000 prisoners set free in October at the start of the month of fasting.
